Interview with Steve Bliss

Let’s talk about trusts. Can you explain the different types available and when someone might choose one over another?

Certainly. There are many types of trusts, each serving a unique purpose. Today I want to focus on Revocable Living Trusts, which are incredibly common in estate planning.

A Revocable Living Trust allows you, the grantor, to maintain control over your assets during your lifetime. You can change the terms, add or remove beneficiaries, and even dissolve the trust entirely if needed. This flexibility is a major advantage. Consequently, it’s a popular choice for individuals who want to avoid the time-consuming and expensive probate process after they pass away.

Moreover, Revocable Living Trusts offer a degree of privacy that wills lack. The terms of a trust are not publicly available, unlike a will which becomes part of public record during probate. This can be important for some people who value discretion.

It’s worth noting that the trust automatically becomes irrevocable upon your death. At that point, the trustee you named will manage and distribute assets according to the terms you set forth. Ordinarily, this process is much smoother and quicker than probate.

Have you ever encountered any challenges with setting up or administering Revocable Living Trusts?

Over my years of practice, I’ve seen firsthand how valuable these trusts can be. However, there are some situations where things haven’t gone as smoothly as planned.

I remember a case involving an elderly couple who hadn’t updated their trust in decades. Their assets and family circumstances had changed significantly since its creation, leading to confusion and potential disputes among their children. Ultimately, we were able to resolve the issues through careful mediation, but it underscored the importance of regularly reviewing and updating your trust documents.

Another time, a client tried to set up a trust on their own using online templates. While these resources can be helpful for basic understanding, they often lack the nuance required for effective estate planning. Consequently, we ended up having to redo much of the work to ensure it met their specific needs and legal requirements.

What advice would you give to someone considering a Revocable Living Trust?
